1. TERMS USED IN THESE TERMS AND CONDITIONS

1.1    Programme — MADARA Cosmetics Rewards Program, which provides its members the following benefits:
-    A 30% discount on birthdays;
-    Receiving 3% of the amount of each order in points;
-    Referring a friend and receiving 3000 points;
-    Writing a product review on www.madaracosmetics.com and receiving 1000 point.

1.2 Programme Website — MADARA Cosmetics website www.madaracosmetics.com intended for use by Programme Members.

1.3 Identification Number — the unique identifier of a Member is the phone number and e-mail address (ID number) of the registered profile.

1.4 Programme Member — a member of the MADARA Cosmetics Rewards Program; one can become a member by registering at www.madaracosmetics.com.

1.5 Member Account — the Member’s profile on the Programme Website, where the Member can log in to view his/her orders, wish list, product reviews posted in the online store, sign up for newsletters, see his/her registered information as well as the number of points accrued, and receive other services included in the MADARA Cosmetics Programme. The Programme Member is responsible for the accuracy of the information registered in his/her Member Account.

1.6 Application Form — an electronic registration form that an individual completes to join the Programme. By completing the online registration form on the Programme Website, the person confirms his/her consent to become a Programme Member. If a customer already has a profile with the www.madaracosmetics.com store, he/she will automatically become a member of the MADARA Cosmetics Rewards Program, and no account re-verification will be required. 

1.7 Terms and Conditions — these Terms and Conditions, which set out the provisions and procedures for the operation of the Programme and which are binding on Programme Members. Terms not defined herein shall be interpreted in accordance with the relevant laws and regulations of the Republic of Latvia.

1.8 Privacy Policy — information about the processing of personal data of a Programme Member. The Programme’s Privacy Policy is available here.

2. REGISTRATION FOR THE REWARDS PROGRAM

2.1 Registration for the Rewards Program takes place on the www.madaracosmetics.com website. 

2.2 The registration of a User is completed once the User has correctly filled in the registration form and received a confirmation e-mail from MADARA Cosmetics stating that the registration has been successfully completed. 

2.3 A customer who already has a profile on the www.madaracosmetics.com site is not required to re-register for the Rewards Program. A User automatically becomes a Member of the MADARA Cosmetics Rewards Program, and no account re-verification is required.

2.4 The accumulation of Rewards Program points starts from orders placed from 01.10.2024. 

2.5 A User who is a Member of the Rewards Program can accrue Reward points in accordance with these Terms and Conditions and exchange them later for products.

3. REWARDS PROGRAM BENEFITS AND CONDITIONS FOR THEIR USE

3.1 Points can be accrued by MADARA Cosmetics Rewards Program Members only.

3.2 Accrued points can be used as a means of payment for purchasing products. 1000 points is worth GBP 1.00. 

3.3 Birthday Discount — A 30% birthday discount is applied if the Programme Member has set their birthday date in their account.

The discount is automatically applied at checkout when the member adds items to their basket in the online shop www.madaracosmetics.com during their birthday week. 

The birthday discount is valid for a total of 7 days—5 days before the date of the birthday indicated by the Programme Member, on their birthday and the day after. 

This discount cannot be combined with other discounts or promotions available on the website at that time. Excludes gift cards, travel-size products, sets, samples and products marked with the label "NEW."

3.4 Earning Points — when placing an order, a Programme Member receives 3% of the order amount back in points to use them to receive discounts on future purchases.

If an order is paid using both points and the remaining difference, points will be calculated based on the amount paid for the difference.

If the full order amount is covered using Rewards Program points, no points will be calculated or awarded for such orders.

Points are calculated as follows:

If the points are less than 0.5, no points are awarded.
If the points are 0.5 or more, they are rounded up to the nearest whole number.

For example:
0.23 points → 0 points awarded
0.5 points → 1 point awarded
0.73 points → 1 point awarded
1.0 points → 1 point awarded
1.12 points → 2 point awarded

Accrued points are credited to the User’s account after the order is confirmed as completed within 1-3 business days. 

3.5 Attract Friends — Program members have the opportunity to earn additional points by referring friends using a unique invitation link available at https://www.madaracosmetics.com/en/friend-referal.

For each successfully referred friend, the member will receive 3000 points once the referred friend has registered using the provided link and placed an order of at least 30  GBP.

These points will be credited after the referred friend’s order has been confirmed as shipped and 30 days have passed.

As part of the program, AS “Madara Cosmetics” may launch promotional campaigns to increase the number of points earned for successful referrals.

Each Program member can refer up to 5 friends per calendar month.

3.6 Administrator-approved Review —  Program members can earn additional points by writing and submitting reviews for products available on the website. To receive points, members must log into their account before submitting a review.

For each submitted review, the member will receive 1000 points, which will be credited within 7 days after the review has been evaluated and approved by the website administrator.

Reviews must be product-related and consist of at least one complete sentence. The administrator reserves the right to reject reviews that do not meet the requirements.

As part of the program, members can submit one review per product and up to 15 reviews per calendar month. Any additional reviews beyond this limit will not be approved, and points will not be awarded.

4. REDEMPTION OF POINTS

4.1 The points accrued by a customer may be used as a means of payment for the purchase of products available in the online store. If the accrued points do not cover the full price of the product, the customer can pay the remaining amount using other payment methods. In this case, the points earned from this order will be calculated from the part of the purchase for which the points were not used. The customer can redeem the points and continue to add other products to the cart, paying for them as usual. Points cannot be used to pay for gift cards or order delivery.

4.2 Validity Period of Accrued Points — earned points are valid for 365 days from the date they are awarded. If the points are not used within this period, they will be removed from the account. MADARA Cosmetics reserves the right to discontinue the accumulation of points, providing a reasonable period for members to redeem their earned points.

4.3 Exchange of Accrued Points for Cash — the accrued Reward Points cannot be exchanged for cash. A user can purchase MADARA Cosmetics products with Reward Points, redeeming up to one hundred per cent of the value of the product. The value of a particular product in Reward Points is indicated on the Rewards Program Website — the product price.

4.4 Cancellation of Accrued Points — points earned from purchased products will be removed if the user returns any of the received products or if MADARA Cosmetics identifies fraudulent activity by the member."

4.5 A User can check the balance of the accrued Reward Points in his/her Member Account, in the navigation bar. 

5. GENERAL PROVISIONS

5.1 These Terms and Conditions constitute a distance contract between MADARA Cosmetics and a Programme Member regarding the Rewards Program benefits that MADARA Cosmetics is obliged to provide in accordance with these Terms and Conditions. These Terms and Conditions set out the principal rights and obligations of the parties and other relevant provisions. Upon commencement of participation in the Programme, the MADARA Cosmetics customer enters into a distance contract with MADARA Cosmetics based on the following conditions. Before entering the Programme, the Programme Member is informed of the terms and conditions and undertakes to comply with them.

5.2 Although these Terms and Conditions provide a number of benefits to a Programme Member, its main benefit is the accrual of points and their redemption for products.

5.3 MADARA Cosmetics shall not be liable for the User’s losses caused by mistake, misinterpretation of these Terms and Conditions or misunderstanding of their content.

5.4 MADARA Cosmetics reserves the right to amend these Terms and Conditions or cancel the Programme by giving a one-month notice to Programme Members, sending an e-mail to the e-mail address provided by the Programme Member and posting the changes on the Programme Website. If a Programme Member does not agree to the amended Terms and Conditions, the Programme Member must notify of this within one month, sending a notice of withdrawal to support@madaracosmetics.com, stating the Member’s first name, surname and the e-mail address used for registration in the Programme. 

6. REGISTRATION AND ACTIVITY OF A PROGRAMME MEMBER

6.1 Any individual aged 13 or older can become a Program Member by successfully completing the registration form on the MADARA Cosmetics website and confirming the registration email sent to the email address provided in the form.

6.2 Participation in the Programme is free of charge.

6.3 When registering on the MADARA Cosmetics website, a Programme Member is obliged to identify himself/herself. Upon registration, a registration confirmation e-mail will be sent to the registered e-mail address of the Programme Member. Upon confirmation of the e-mail, the Programme Member can start enjoying the full benefits of the Programme. If the registration form is filled in incompletely or the registration confirmation e-mail is not confirmed, MADARA Cosmetics reserves the right to block the prospective member’s account until the deficiencies are corrected.

6.4 The completed application form is registered immediately, and the registration confirmation e-mail is sent to the Programme Member’s e-mail address. Once a Member is registered in the Programme and has confirmed the registration confirmation e-mail, he/she can monitor his/her account status and take advantage of other special benefits on the Programme Website. 

6.5 One Member Account can be registered per person per e-mail address, and only the person who has completed the application form and agreed to the terms and conditions can participate in the Programme.

6.6 In case of violations, MADARA Cosmetics reserves the right to close the member's account.

6.7 MADARA Cosmetics reserves the right to temporarily block or close the account of an existing Member if fraudulent activity is detected, as well as not to register a new Programme Member if facts are found about the previous fraudulent activity of the particular person within the scope of this Programme. Fraudulent activities may be defined as both activities relating to fraud and other activities that may interfere with the operation of MADARA Cosmetics, the Programme or the Programme Website and/or cause direct or indirect damage or loss.

6.8 MADARA Cosmetics reserves the right to change the range of products and services included in the Rewards Program without prior notice. We will notify you of any significant changes or updates in the News section of the Rewards Program Website.

7. CLOSING PROVISIONS AND DISPUTE SETTLEMENT

7.1 A Programme Member is obliged to use the benefits granted to him/her in good faith and not to pass on the Programme Member’s identification and Member Account access data to third parties. MADARA Cosmetics shall not be liable for any losses resulting from the malicious acts of a third party.

7.2 In the event of any changes to personal data, the Programme Member should contact Customer Service by writing a e-mail to support@madaracosmetics.com or calling +371 66154811.

7.3 Participation in the Program may be ended by either the Program member or MADARA Cosmetics. To discontinue participation, the Program member must contact MADARA Cosmetics Customer Support using the contact details provided in these Terms. 

7.4 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Latvia.

7.5 All disputes relating to these Terms and Conditions shall be settled by negotiation. If no agreement is reached, disputes shall be settled in court in accordance with the laws of the Republic of Latvia.

7.6 If a court or other competent authority deems any provision of these Terms and Conditions to be unreasonable or unfeasible in whole or in part, the remaining sections of these Terms and Conditions shall remain valid and binding.

7.7 If a Programme Member believes that MADARA Cosmetics has violated these Terms and Conditions or other relevant laws and regulations and this has affected the Programme Member’s ability to exercise his/her rights, and such situation cannot be resolved through negotiations, the Programme Member may submit an application to the national consumer protection authority:

8. PROCESSING OF PERSONAL DATA

8.1 Program members' data will be processed to manage and maintain their participation in the Program. By joining, members confirm that they have read the Privacy Policy, available at: Privacy Policy.

8. 2 The personal data of the Program Member will be used to identify the Program Member, to receive, process and deliver orders, to prepare accounting documents, including invoices, to refund overpaid amounts and to refund amounts for returned goods, to administer financial and other obligations arising from these Terms and Conditions and other cooperation documents between the parties, as well as for the use of the services offered on the MADARA Cosmetics website.
